Warranty Statement

Limited Warranty

The manufacturer agrees that each vehicle operated by the original purchaser under normal use and conditions in the Continental United States, purchased from our retail stores or website, will be free from defects in material or workmanship for a period of 30 days (1 year for the internal engine parts), subject to the requirements, exclusions and limitations stated below which will be strictly applied.  If the vehicle is rented or used for commercial purposes, this Limited Warranty is null and void.  ATVDiscounter.com will only act as an agent of retail customers to facilitate the submission and processing of warranty claims to the manufacturer.  ATVDiscounter.com is not the warranty issuer and is no way liable for any issues that may arise from factory defects or oversights.   

 

ATVDiscounter.com is only the product dealer and all warranties are provided from the manufacturer.

Warranty Guidelines

The warranty will only become active once the post delivery PDI has been executed on the unit.  The PDI process has to be documented within two weeks of receipt of the unit.  The buyer waives all warranties on the unit in the event the post delivery PDI was not performed within the first two weeks of receiving the unit.

 

We require that the original part(s) be returned to us along with a brief description of the problem, ticket number, order number, vin number, and your name prior to a replacement part will be sent. Items are covered for regular use only and if we determine that the problem is due to abuse or misuse, we will not cover the part under warranty. In this case, the customer may incur the charges for the part(s). We will make the final decision regarding if the merchandise is covered upon our receipt of the parts(s).

Our warranty is in effect ONLY under these circumstances:
1. The product is completely assembled correctly by an automotive/motorcycle technician with a faxed receipt
2. The product is used under normal conditions; and for its intended purpose.
3. The necessary and consistent maintenance has been performed on the unit; ie. oil changes, chain lubrication, filter changes, and gas treatments.

ONE YEAR LIMITED WARRANTY

Subject to the requirements, exclusions and limitations stated below, the internal oiled engine parts are warranted to the original retail purchaser against defects in materials and workmanship by the vehicle manufacturer, arising from normal use for one (1) year from the date of delivery.  ATV Discounter will act as an agent of retail customers to facilitate the submission and processing of any engine warranty claim on their behalf to the manufacturer.  Dealers or any other purchaser of vehicles for resale or not for personal use must deal directly with the manufacturer.

 

30 DAY LIMITED WARRANTY

Subject to the requirements, exclusions and limitations stated below, all other components of the vehicle are warranted to the original retail purchaser or dealer against any defect in the materials and workmanship by the vehicle manufacturer arising from normal use for thirty (30) days from the date of delivery.  ATV Discounter will act as an agent of retail customers and dealers to facilitate the submission and processing of any warranty claim on their behalf to the manufacturer.

 

NORMAL USE

This Limited Warranty covers only defects in original components which arise from normal use and does not apply if the vehicle has been subjected to negligence, crash, accident, abuse, misuse, neglect, overload, extreme riding, racing, stunt work, competitive racing, vandalism, fire or theft.

 

MAINTENENCE AND DOCUMENTATION REQUIREMENT

The manufacturer requires that for any engine to be eligible for replacement evaluation and approval, the purchaser must present with their claim, third party documented proof that the engine was maintained as specified below for the vehicle. 

 

The oil that the vehicle is shipped with must be replaced after the break-in period, 300 km (~185 miles).

 

The following maintenance must be performed every 1000 km (~600 miles) or 3 months (after the break-in period), whichever is first:  Oil, oil filter (where applicable), air filter, fuel filter, spark plug, and radiator coolant (where applicable).

 

Acceptable forms of documentation are copies of dated service tickets from a professional service center or copies of dated retail receipts for the wear parts and materials required to perform the service.

 

WEAR PARTS EXCLUDED

Normal wear items, including but not limited to, hoses, lubricants, gaskets, brake handles, brake shoes, brake pads, seats, seat covers, light bulbs, fuses, spark plugs, tires, rims, drive belts, additional belts, batteries (manufacturer only provides starter batteries), starters, air filters, fuel filters, plastics, moldings, fairings, body parts, engine covers, body panels, gaskets, CV boots, clutch wear parts, any part made from rubber, battery chargers, shocks, clips, nuts, bolts, fasteners, or chains will not be replaced due to wear.

 

LIMITATIONS

The sole responsibility of ATVDiscounter.com under this limited warranty shall be to facilitate the submission of claims to the appropriate manufacture, to procure and deliver those warranted replacement parts and, if brought directly to our service center, perform associated repairs.  Procurement of replacement parts is subject to availability from the manufacturer.  Transportation/Shipping of any vehicle to and/or from any of our service centers shall be the sole responsibility of the owner. For a current list of our service center locations, please visit our website at www.atvdiscounter.com.  Any costs of third party labor or any additional parts, tools or procedures required to replace a defective part is hereby excluded.

 

All other obligation or liabilities, including incidental or consequential damages or contingent liabilities arising out of the failure of any parts to operate properly, are hereby excluded, including but not limited to any damages resulting from loss of use, inconvenience, loss of time, commercial loss, or any other type of damages or expenses, general or specific, foreseen or unforeseen, unless applicable state law provides otherwise.  (ie. rental car, gasoline charges, loss of income, towing charges, telephone calls, property damage, or legal fees)

DISCLAIMERS

This warranty is expressly in lieu of all other express warranties and representations.  ATVDiscounter.com makes no representation or warranty of any kind, express or implied, with respect to vehicles whether as to merchantability, fitness for a particular purpose or any other matter.  No one, including an authorized ATVDiscounter.com dealer is authorized to make further or additional warranties on behalf of ATVDiscounter.com.

 

All implied warranties of merchantability and fitness for intended use are limited to warranty periods stated above, unless any applicable state law provides otherwise.

 

IF THIS WARRANTY IS NOT SIGNED, POSTMARKED AND MAILED TO ATVDiscounter.com , BY THE TENTH DAY AFTER DELIVERY OF THE VEHICLE, ALL EXPRESS WARRANTIES SHALL BE NULL AND VOID.

 

ATVDiscounter.com MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES AND THERE ARE NO OTHER WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE OF THIS LIMITED WARRANTY. Errors and/or omissions may apply.

 

REQUIRED WARRANTY CLAIM PROCEDURE

Within five (5) days of discovering a defect with your vehicle, you must either notify one of our service centers and make arrangements to bring the vehicle in for inspection, or submit a ticket to the Parts and Service Department via our issue tracking system with a detailed description of the defect.  You can access our issue tracking system at http://atvdiscounter.helpserve.com.  If you do not have internet access you may contact customer service at  (817) 717-7000  and they will assist you in creating a ticket.

 

ATVDiscounter.com will acknowledge such receipt of claim as a response to your ticket as soon as possible, but no later than five (5) business days after the creation of the ticket.

In order to help our technicians with identification, and speed up the processing of your claim, it would be helpful if you would attach (to your ticket) photos of all four sides of your vehicle and close up photos from multiple angles of the defective part(s).

 

All returns must be authorized by ATV Discounter.  ATVDiscounter.com will not accept any unauthorized returns.

 

Any defective part must be returned by prepaid shipping (no CODs accepted) within thirty (30) days from date of return authorization for inspection and approval, in order to qualify the claimant for replacement under this limited warranty.  The purchaser is responsible for paying all associated shipping costs for returning defective parts to ATVDiscounter.com.  Any warranted replacement parts will be shipped to the purchaser at no additional cost.

 

Additional Instructions for Engine Returns

·         Owner must supply adequate documentation of general engine best practices and maintenance including oil changes, fuel filter changes, air filter changes, and spark plug replacements.

·         Owner must supply documentation from a certified mechanic with a valid engine diagnostic showing a faulty engine.

·         ATVDiscounter.com will additionally run diagnostics on the returned engine to deem if the engine is at fault.

 

Please note that replacement parts procurement is subject to availability from the manufacturer.  ATVDiscounter.com does not manufacture parts.

For your safety and the safety of all riders of your vehicle, ATVDiscounter.com recommends that any assembly or maintenance on your vehicle be performed by a certified mechanic. This will ensure that any unforeseen issues that arise will be adequately addressed by a trained professional. Possible issues that could arise include, but are not limited to, electrical connections that have become disconnected, vacuum or fuel hose(s) that have become dislodged, and/or loose nuts and bolts that may need to be tightened. While these issues are usually simple for a mechanic to fix, they can be extremely difficult to troubleshoot for someone lacking proper training.
